Certification of Specialists

Federal law № 240 about changes in Town Planning Code dd. June 27, 2010 made ​​a number of amendments affecting the Companies entered SROs. One of them is an obligation for experts who declared in obtaining approval of SRO to have certification in addition to mandatory training. From October 1, 2010, this requirement is mandatory for the implementation of all the organizations entered SROs.

If before October, 1 you could get the certificate according the old rules, now the new Town Planning Code comes into effect which was significantly changed and supplemented in July. In addition to changes in conduct of the indemnification fund and be eligible to control the activities of all members of the SRO, the code has another item, which tightens the requirements for those who are going to join the SRO. So, now employees of a construction company that enters SROs are required to pass certification, without which they can not obtain a certificate of admission to the construction work. In addition, from now on all company employees must be permanent staff members. If before it was assumed that part of the team worked part-time if their position does not require a permanent presence in the workplace, but now this feature was excluded from the official building regulations. Thus, if not all of your employees call your company as their main place of work, you risk not to get access to entry SRO.

Town Planning Code before making edits and comments contained several controversial points, which required compulsory clarification. Therefore the law that changes the regulation of certain aspects of the construction companies has long been debated in State Duma. Now discrepancies and issues no longer appear because the main issues from previous version of the Code were corrected. August, 2^nd  2010 amendments to the Town Planning Code as the Federal Law № 240 were published in Rossiyskaya Gazeta, however, it finally came into effect only on October, 10.

Among other things, an article was added to the Code, which established a mandatory government control over the activities of self-regulatory organizations. The control also includes planned inspections every three years. In addition to the planned audit of the state control of SRO can organize unscheduled inspections. The purpose of these activities is to ensure full compliance of the members of the SRO with the rules established in this Code. Any violation found during the inspection, may be appealed to arbitration court.

But far more significant changes relate to those companies that are going to become a member of the SRO. Now, in order to enter self-regulatory organization, you must obtain another certificate - a certification document for each employee. Specialist certification allows you to select higher quality staff, which in the construction industry must meet high standards of professionalism.

Previously, this procedure was in some different context. For example, every five years, every employee of the construction company working in construction, had to undergo professional courses to meet the requirements of the level of this complicated area of ​​work. Now, in addition to periodic professional development employees of the construction company should also have official confirmation of certification.

To pass certification, you must submit to the appropriate entity necessary declaration and a number of other documents six weeks before the end of last certification. If all the documents meet the certification commission, the license will be renewed. Otherwise, your employees will be invited to attend development courses.
